Contest Rules and Regulations
Organizer and Eligibility
1. The REPAIR CHALLENGE [“Contest”] is organized by WD-40 Company's Marketing Distributor in Malaysia, Bun Seng Hardware Sdn. Bhd. (Company Registration No. 96380-W) [“the Organizer”]. The Contest is an internet photo and video contest, with no obligation to purchase. It will be held from 01/04/2024 until 31/05/2024 as shown on https://repairchallengemy.wd40.asia. The Contest is open to all residents of Malaysia aged 18 years and above as of 01/05/2024 [each “Participant” and collectively, the “Participants”]. The best submission wins! The WD-40 MALAYSIA "REPAIR CHALLENGE": Terms & Conditions shall hereinafter be referred to as the “Contest Rules and Regulations". In the event the Participant is not agreeable to any or all of the Contest Rules and Regulations, the Participant must not participate in this Contest.
2. The following persons are not eligible to participate in the Contest:
2.1. Employees of the Organizer [including its subsidiaries, affiliates and related companies] and their immediate family members [i.e., spouse, children, parents, siblings (and their spouses)]; and/ or
2.2. Representatives, employees, servants and / or agents of advertising and / or promotion service providers of the Organizer [including their subsidiaries, affiliates and related companies], and their immediate family members [i.e., spouse, children, parents, siblings (and their spouses)].
3. The Organizer shall reserve the right to exclude and / or disqualify persons who are not eligible to participate and / or Participants who are in breach of the Contest Rules and Regulations.
Duration
4. The Contest will run from 01/04/2024 until 31/05/2024 (11:59 p.m. Kuala Lumpur Local Time) [“the Contest Period’]. The Organizer reserves the right at its absolute discretion to vary, postpone, reschedule and / or extend the Contest Period and / or cancel / terminate the Contest at any time without prior notice. All entries received outside the Contest Period will be automatically disqualified.
Qualifying Criteria and Submission of Entries
5. Create a genuine REPAIR CHALLENGE submission using photo or video. The theme of this Contest is ‘Repair Challenge’. hereinafter referred to as “the Theme”.
6. Go to https://repairchallengemy.wd40.asia, complete a registration form via Social Media or Email Sign Up.
7. Upload your REPAIR CHALLENGE photo or video along with a short description.
8. The content of the REPAIR CHALLENGE submission must clearly explain or demonstrate how a WD-40 product is being utilised, i.e., to solve a problem or fix any DIY issues. Additional criteria include, but are not limited to,
VIDEO CRITERIA:
8.1. The video must contain genuine WD-40 products utilized or applied at problem area(s).
8.2. WD-40 products used should be in compliance with its approved usage as stated on the label, there must not be any misleading/misguidance of product usage.
8.3. The video should contain WD-40 product spray out action, if possible.
8.4. The jingle/music utilized, if any, must be royalty free music.
8.5. The video resolution should be at least a minimum of 640 x 480 pixels for Standard Definition or, preferably 1280 x 720 pixels for High Definition.
8.6. The video created by the Participant addressing the problem area(s) must be authentic and original.
8.7. The video must be able to convey the message of fixing problem area(s) using WD-40 products, preferably with a description narrated by the Participant, if any.
8.8. Background of the video should not contain another brand(s) or competing brand, regardless of whether there was any intention to promote such other brand(s).
8.9. The video will not be accepted if:
(a) it is created with photos montage of fictitious situations, i.e., stock images, copied images, etc.
(b) the WD-40 product is used in a sexual, abusive, racist, or violent manner, or involving the illegal usage of substance.
(c) usage of the WD-40 product is not in line with the approved usage as labelled, i.e., use of product as engine oil, or usage of product contrary to its approved usage.
PHOTOGRAPH CRITERIA:
8.10. The photograph must contain genuine WD-40 products utilized or applied at problem area(s).
8.11. WD-40 products used should be in compliance with its approved usage as stated on the label, there must not be any misleading / misguidance of product usage.
8.12. The photograph should contain WD-40 product spray out action, if possible.
8.13. The resolution of photograph should be at least a minimum of 600 x 600 pixels, 150dpi, or preferably 1200 x 1200 pixels, 150dpi.
8.14. The photograph captured by the Participant addressing the problem area(s) must be authentic and original.
8.15. The photograph must be able to convey the message of fixing problem area(s) using WD-40 products.
8.16. The background of the photograph should not contain another brand(s) or competing brand, regardless of whether there was any intention to promote such other brand(s).
8.17. The photograph will not be accepted if:
(a) it is created with photos montage of fictitious situations, i.e., stock images, copied images, etc.
(b) the WD-40 product is used in a sexual, abusive, racist, or violent manner, or involving illegal usage of substance.
(c) usage of the WD-40 product is not in line with the approved usage as labelled, i.e., use of product as engine oil, or usage of product contrary to its approved usage.
9. Additionally, submission containing the following will not be accepted:
9.1. content obviously contrary to law and/or good morals
9.2. spoofing
9.3. inappropriate, objectionable and / or unfit for publication (e.g., pornographic images, nudity, obscenity, violence and / or hate speech);
9.4. content denigrating the Organizer, its products and / or that harm in any way the goodwill and the commercial reputation of the Organizer;
9.5. content advocating the consumption of alcohol, drugs, violent behaviour and / or any illegal activity;
9.6. content depicting a situation that pose a risk to or impact health and / or physical integrity;
9.7. content relating to products that are not any of the WD-40 products as described in paragraph 15 below; and
10. Each submission must be the original work of the Participant and must not be copied, in whole or in part, from any other source.
11. Team and / or group participation is strictly prohibited. Submissions must comply with the technical requirements indicated on the Contest site at https://repairchallengemy.wd40.asia.
12. Submissions must not violate or infringe the rights of any third party, including copyright, trademark, patent, confidentiality and / or publicity rights (for example, not including third party logos). Do not use music, videos or photos created or performed by another person. If people other than the Participant appear in the Participant's video and / or if another person recorded the entry video and / or was otherwise involved in the creation and / or development of the entry video, it is the sole responsibility of the Participant to obtain the prior consent and waiver of all rights relating thereto by all such persons in writing. The Organizer reserves the right to make the awarding of the prize conditional on the presentation of satisfactory proof of the consent of this third party.
13. Submission must relate to the Theme of the Contest.
14. All photographs and videos submitted will be screened for any inappropriate images or context before being uploaded on https://repairchallengemy.wd40.asia. A confirmation email will be sent out upon receipt of your submission. Entries found to be non-compliant with any of the Contest Rules and Regulations will be disqualified.
15. For the REPAIR CHALLENGE submission, any one of the WD-40 products is accepted, i.e., WD-40® Multi-Use Product (Classic Can, Smart Straw, EZ Reach) and WD-40 Specialist® (including Bike and Automotive) range.
16. Share the uploaded link with your friends, family or social networks on https://repairchallengemy.wd40.asia.
17. Each Participant may submit more than one [1] entry.
18. By participating in the Contest, the Participants agree to comply with the Contest Rules and Regulations. Failure to comply with the Contest Rules and Regulations will result in the automatic disqualification of participation.
19. Participation in the Contest takes place exclusively on the internet on the dates indicated under ‘Duration’. Participants can connect to the Contest site which is accessible 24 hours a day at the following address https://repairchallengemy.wd40.asia, except during any maintenance operations on the site's servers.
20. The Organizer is not responsible for any error, omission, interruption, deletion, defect, delay, failure in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction or traffic congestion on the internet and / or telecommunication services.
Contest Announcement and Communication Support
21. This “REPAIR CHALLENGE” is accessible on the website, https://repairchallengemy.wd40.asia. The “REPAIR CHALLENGE” is advertised at the point of sale on all WD-40 products available at retail locations distributing WD-40 products in Malaysia, conducted via point-of-sale advertising, on-line via the Contest at https://repairchallengemy.wd40.asia and displayed in advertisement on Google, Facebook, and Instagram.
Prizes & Winner Selection Process
22. The Contest is not a game of chance. Selection of winners will be at the sole discretion of the Organizer, and will be based on the following:
22.1. Only valid entries will be eligible to be selected.
22.2. All entries will be judged based on the judging criteria set out in paragraph 24 below taking into account the criteria set out in paragraph 8 above.
23. Winners will be announced on the week of 10th Jun 2024 on WD-40 Malaysia Facebook Page https://www.facebook.com/WD40Malaysia/ and Instagram https://www.instagram.com/wd40malaysia.official/.
24. The criteria for judging the Prize Winner are as follows.

25. There are a total of 63 prizes: one [1] iPhone 15 128GB, one [1] PlayStation 5 with Disc Console, three [3] Garmin Forerunner 55, twenty [20] Montigo Thermal flask 530ml, forty [40] WD-40 sample box to be won at the end of the Contest Period as categorized per below:
26. Each participant is eligible to win a maximum of TWO [2] prizes throughout the Contest Period.
26.1. All the prizes mentioned in this Contest Rules and Regulations are non-transferable, non-modifiable, non-exchangeable and non-refundable.
26.2. Selected winners will receive their prizes via courier services. Cost of the courier service will be borne by the Organizer. For delivery purposes, the Organizer will provide the courier service with the contact information provided by the Participant upon registration.
27. The Organizer reserves the right to verify that the winners have adhered to the Contest Rules and Regulations. Entries found to be non-compliant may result in the winner being disqualified and the revocation/forfeiture of their prizes.
28. All winners will receive an email notification. The Organizer will not be held liable in the event of non-receipt or delayed delivery of the email notification to the winners.
29. The list of winners will be announced on the Organizer’s Facebook Page at https://www.facebook.com/WD40Malaysia/ and Instagram at https://www.instagram.com/wd40malaysia.official/.
30. The Organizer shall not be liable to the Participants for any liability, mishap, injury, damage, claim or accidents [including death] that may occur resulting from participating in the Contest or the acceptance, possession, use or misuse of any of the prizes. By participating in the Contest, each Participant agrees to release and hold the Organizer harmless from any and all liability for any injuries, loss or damage of any kind, including personal injury, death or property damage, arising from the participation in the Contest or acceptance, possession, use or misuse of any prize.
31. All costs incurred by the Participant including without limitation postal charges, transport costs, accommodation, meal costs and / or any other costs, fees and / or related expenses incurred by the Participant as a result of their participation in the Contest shall be borne by the Participant. The Organizer shall not be under any obligation to reimburse the Participant for any such costs and expenses incurred. Save for the costs of courier service to deliver the Prizes, all costs incurred arising from the redemption, acceptance, possession or use of the prizes shall be borne by the Participant.
32. Winners are solely responsible for determining what (if any) income, sales or similar taxes are payable in connection with any prizes received, and have the sole responsibility to report, pay, settle and/or remit the correct taxes to the appropriate tax authorities in such jurisdiction in which winners may be liable to tax. The Organizer is not responsible for any such taxes in connection with any prizes distributed.
Rights of the Organizer
33. The Organizer reserves the right, at its absolute discretion, to review and vary the selection process of the prize winners contained herein at any time without prior notice. The judges’ decision is final and any correspondence relating to the selection of the winner will not be entertained.
34. The Organizer reserves the right, at its absolute discretion, to substitute any of the prizes with that of similar value, at any time without prior notice. The Prizes are non-transferable and all prizes are given on an “as is” basis and are not exchangeable for cash, credit and other items or voucher in part or in full.
35. By participating, all Participants agree and acknowledge that all intellectual property rights created in connection with the submissions shall belong to WD-40 Company (with a licence to use the same in favour of its related entities and the Organizer).
36. If the details or information of the winner are unusable (incomplete or incorrect), they will lose the benefit of their prize which will remain the property of the Organizer. The Organizer reserves the right to put it back into play in this Contest or in subsequent contest(s).
37. The Organizer shall not be responsible for any delays, loss or damage caused in relation to the delivery of the prizes. Likewise, the Organizer will not assume responsibility or liability for the prizes and does not warrant or make any representations as to the quality, merchantability, fitness for a particular purpose or use, health and safety of the prizes.
38. The Organizer disclaims all responsibility for all incidents and / or accidents that may occur during the period of enjoyment of the prize awarded and / or as a result of its use.
39. The Participants authorize all checks concerning their identity and their domicile. Any indication of false identity or address will result in the immediate elimination of the submission / entry.
Authorization of Participants - Intellectual Property - Image Rights
40. The Participants authorize WD-40 Company, its related entities and the Organizer to use and exploit, in any area of the world, free of charge, the photos, videos and other information produced and uploaded by the Participants on the Contest site at https://repairchallengemy.wd40.asia as part of the Contest, as well as their names, first names, and image rights, provided always that such use cannot give rise to any consideration (save for prizes won, if any).
Assignment of Rights on Videos and / or Images Submitted
41. Each participant grants the Organizer, its representatives and WD-40 Company the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable and sublicensable right, to use, perform, exhibit, reproduce, edit and / or otherwise exploit the Participant's video and / or photograph, in any way and in all known distribution channels, locations and / or media, without further notice and / or compensation of any kind for the Participant. The Participant further waives any moral rights and / or similar natural property rights that they may have in the Participant's video and / or photograph. The Participant further agrees, at the request of the Organizer and without compensation of any kind, to sign any additional document in order to effect or record the granting of the rights to the Organizer.
42. By participating in the Contest, all Participants graciously authorize the taking of photographs, slides, fixation on electronic medium, film, paper, videograms or on any other medium, of their image, names, first names, speeches in full or in extracts to reproduce them on any type of medium, digitize, represented by any mode of public representation, in particular television or all telecommunications services, cable distribution, on all networks, in particular the Internet and in all territories. This authorization is valid for all promotional, advertising, or public relations purposes in relation to the Contest and / or the activities of the Organizer, WD-40 Company or any related entities of WD-40 Company around the world.
43. The images used on the Contest site, the objects represented, the brands and trade names mentioned, the graphic and computer elements and the databases making up the Contest site, are the exclusive property of their respective owners and shall not be extracted, reproduced or used without the written permission of the latter.
44. Any resemblance of characters or elements of the Contest with other fictitious characters or other elements of already existing contests, is purely fortuitous and shall not impose any liability or responsibility on the part of the Organizer or its service providers.
Privacy Notice
45. By participating, the Participants consent to the collection, use, processing and / or disclosure by the Organizer (on behalf of WD-40 Company) any and all of the Participant’s personal data (including without limitation the Participant’s name, photograph or image in connection with the Contest) and any photographs, videos or other information submitted, for the purpose of any advertising, publicity, marketing and promotional activities in any area of the world, conducted in such manner as the Organizer or WD-40 Company sees fit, in any media and without additional compensation, notification or permission, and any other activities that are ancillary to the Contest. Participants shall not be entitled to claim ownership and / or other forms of compensation for such materials used by WD- Company, its related entities, or the Organizer.
46. By participating in the Contest, the Participants consent to the Organizer and any of its holding companies, subsidiaries, related or affiliated companies including, without limitation, WD-40 Company or any related entities of WD-40 Company, service providers, advertising, media buying and promotional agencies, agents and contractors who provide administrative and business support to WD-40 Company, supply WD-40 Company with products and act on behalf of WD-40 Company (“Authorised Third Parties”) collecting, using, disclosing and/or processing the personal data provided by the Participants in the entry form for purposes of the Contest. This includes disclosing the Participant’s name, photographs and other personal information to the general public for purposes of advertising, publicity, marketing and promotional activities in any area of the world, conducted in such manner as the Organizer or WD-40 Company sees fit, in any media and without additional compensation, notification or permission, and any other activities that are ancillary to the Contest.
47. The Organizer may also use and/or process the Participants’ personal data for purposes of contacting and sending the Participants marketing and promotional information or materials about their products, services, any promotions, events or contests organized by the Organizer.
48. In the event the Participant agrees to share and disclose personal data of a third party with the Organizer, the Participant shall obtain the express written consent of that person to share and disclose his/her personal data with the Organizer and to being contacted by the Organizer. The Participant shall submit proof of such express consent from the third party. The Participant shall indemnify the Organizer in the event of any loss or damage suffered as a result of any claims brought by the third party arising from the collection, use, processing and / or disclosure of their personal data.
49. The Organizer may retain Authorised Third Parties to store or process the Participants’ personal information. All such Authorised Third Parties are contractually bound to take reasonable measures to keep information secure and not to use the Participants’ personal information in any way other than that which is specified here.
50. Please note the Organizer requires the Participants’ personal data in order to process the Participants’ participation in the Contest, without which the Organizer will not be able to process the Participants’ submission and the submission will be disregarded and disqualified.
51. Should Participants wish to have access to their personal data or to update or make any corrections or to withdraw their consent to any use of their personal data, Participants may contact the Organizer at the following:

Other Terms and Conditions
52. The Participants by participating in this Contest agree to fully comply with and abide by the Contest Rules and Regulations herein.
53. Any false and / or incomplete information or contact details provided by the Participant will result in the immediate disqualification of the Participant from the Contest. The Organizer shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. The Participant is responsible for ensuring that all personal and other information given (including his name, full address etc.) are truthful, complete, accurate and in no way misleading.
54. The Organizer reserves the right to exclude, disqualify or revoke the prize of any person who does not fully comply with the Contest Rules and Regulations.
55. The Organizer may at its sole discretion disqualify any Participant if found or suspected of cheating or tampering with the Contest submission process or in breach of any of the Contest Rules and Regulations and the Organizer reserves the right to take legal action against anyone who has committed or attempted to commit fraud or other acts harmful to the Contest.
56. Pictures of prizes shown on the Contest entry form are for illustration purposes only and may differ from the actual item. Price shown is correct at the time of printing.
57. The Contest Rules and Regulations may be amended from time to time and shall prevail over any provisions or representations contained in any other promotional material or advertising of the Contest. Participants are highly advised to visit the Organizer’s website from time to time to ensure that the Participants are aware of any updates and changes made.
58. By participating in the Contest, Participants agree to be bound by the Contest Rules and Regulations. Participants further agree to be bound by all the decisions of the Organizer, which shall be final and binding in all respects.

60. The Contest Rules and Regulations shall be interpreted and governed in accordance with the laws of Malaysia and the parties hereby irrevocably agree to submit to the exclusive jurisdiction of the Malaysian courts.
61. In the event of any inconsistency or contradiction in the terms between the English version and the Bahasa Malaysia version of the Contest Rules and Regulations, the English version shall prevail.
